This manual describes ONmoney’s structure and functions, the records it holds, records that may be available without a formal request, how to submit a PAIA request, the fees that may apply, grounds on which access may be refused and remedies available to a requester.
The Information Regulator has published a guide explaining how PAIA works and how to exercise access rights. The guide and prescribed forms are available from the Information Regulator’s PAIA resources.
Subject to confidentiality, privacy, intellectual-property and legal restrictions, the following may be available through the website or on request without a formal PAIA application:
Records may be held under legislation applicable to the business, including PAIA, POPIA, the Companies Act 71 of 2008, Consumer Protection Act 68 of 2008, Electronic Communications and Transactions Act 25 of 2002, National Credit Act 34 of 2005, Financial Advisory and Intermediary Services Act 37 of 2002, Financial Intelligence Centre Act 38 of 2001, tax legislation, labour legislation and other laws applicable to the services provided.
ONmoney may hold records relating to:
A requester should use the prescribed PAIA request form for a private body, identify the requested record with enough detail, explain the right being exercised or protected, state why the record is required for that purpose, provide proof of identity and authority where acting for another person, and provide a preferred form of access and contact details.
Send the completed request to the Information Officer using the contact details in this manual. The statutory process and time periods apply after a valid request is received.
A request fee and access or reproduction fees may apply as prescribed by law. Where permitted, ONmoney may require payment before processing or providing access. A personal requester seeking access to their own personal information may have different fee treatment under applicable law.
Access may be refused where PAIA requires or permits refusal, including protection of another person’s privacy, confidential commercial information, privileged legal material, safety or security, research information, intellectual property or records whose disclosure would breach a legal duty. Each request is assessed on its facts.
ONmoney processes categories of personal information described in its Privacy Policy. Data subjects may request access to or correction of their own information through the POPIA process. A PAIA request may be required where the requested access falls within PAIA.
The requester will be notified of the decision and any applicable fee. If access is refused or no response is received within the statutory period, the requester may pursue remedies available under PAIA, including a complaint to the Information Regulator or an application to a competent court, subject to applicable requirements and time limits.
This manual is available on the ONmoney website and, where required, for inspection at the company’s principal place of business during normal office hours. A copy may also be requested from the Information Officer.
This manual will be reviewed and updated when material information changes or when required by law.
